
Former special counsel Jack Smith has been referred to the Department of Justice for a probe into prosecutorial misconduct over his unscrupulous methods while conducting the failed witch hunt against President Donald J. Trump.
A malicious and ruthless operator, the former Hague prosecutor was hand-picked by then-Attorney General Merrick Garland to spearhead two cases against Trump, one involving classified material stored at Mar-a-Lago and the other a thoroughly dishonest sham to frame him for leading an “insurrection” at the U.S. Capitol on January 6, 2021.
Smith crossed the line when he secretly subpoenaed telecommunications companies for the cellphone records of nine Republican members of Congress as part of the FBI’s “Arctic Frost” investigation, a shocking abuse of power.
Sen. Marsha Blackburn (R-Tenn.), who was one of the lawmakers targeted, announced that she and other Republicans sent a letter to Attorney General Pam Bondi on Friday, accusing Smith of spying on “duly elected members of Congress” and calling for him to be referred to the Office of Professional Responsibility, which is tasked with investigating professional misconduct by DOJ lawyers.

“Jack Smith was a rogue special counsel on a weaponized witch hunt against Republican Senators,” Blackburn wrote in a post to X. “There must be consequences for this abuse of power. I just sent a letter to @AGPamBondi urging the DOJ to investigate him.”
The Tennessee Republican shared a link to a report from the New York Post, which first broke the news about the letter.
“As part of Jack Smith’s weaponized witch hunt, the Biden DOJ issued subpoenas to several telecommunications companies in 2023 regarding our cell phone records, gaining access to the time, recipient, duration, and location of calls placed on our devices from January 4, 2021, to January 7, 2021,” the letter said.
“We have yet to learn of any legal predicate for the Biden Department of Justice issuing subpoenas to obtain these cell phone records,” added the Republican lawmakers who, in addition to Blackburn, include Sens. Lindsey Graham (R-SC), Tommy Tuberville (R-AL) and Dan Sullivan (R-AK) along with Rep. Mike Kelly (R-PA), all of whose call logs were sought by Smith.
The letter also accused the Biden regime’s lawfare goon of infringing on elected officials’ constitutional rights and that he “trampled on this separation of powers principle that underlies our system of government,” according to the New York Post.
“This is especially true given the invasion of our privacy was directly connected to our core legislative functions protected by the Speech or Debate Clause of our Constitution,” the letter reads. “To the best we can tell, Smith’s team went on this fishing expedition for one simple reason: we are Republicans who support President Trump.”
The Republicans also called for the findings to be sent to the Tennessee Board of Professional Responsibility and the New York Attorney Grievance Committee, states where Smith is licensed to practice law, for potential disbarment. They wrote that the states “should consider all options in holding Smith accountable for this misconduct—including disbarment.”
“The conduct that Jack Smith and his team engaged in harkens back to a dark chapter in American history that we have not seen since the days of J. Edgar Hoover, and the completely corrupt investigation and prosecution by the FBI and DOJ of the late Senator Ted Stevens of Alaska,” the GOP lawmakers wrote. “We must ensure that we never return to these disgraceful eras.”

This week, Smith was sent a letter by House Judiciary Committee Chairman Rep. Jim Jordan (R-Ohio) calling for him to give a transcribed interview, stating that his testimony “is necessary to understand the full extent to which the Biden-Harris Justice Department weaponized federal law enforcement.”
