The government has released new statistics showing the backlog of employment tribunal cases at its highest ever level. But wait – here comes the Employment Rights Bill…
Official MoJ statistics now released:
“At the end of Q2 2025/26, there were 515,000 open claims in total, covering single and multiple claims.
Single claim open caseload (at 52,000) has reached its highest ever level in the timeseries, exceeding the peak of 44,000 in Q3 2020/21 for the second consecutive quarter, and up 33% compared to the same period in 2024/25.”

Shadow Business and Trade Secretary Andrew Griffith, who has been leading the charge against the bill, tells Guido:
“Employment tribunal backlogs in many areas already stretch back well over two years. For the government to seek to add to this with a 330 page red tape bill is completely potty. They should focus on clearing the backlog and getting millions of working age adults off welfare and into work.”
After concluding a grubby deal with Labour to get five new peers (they couldn’t get more?) the LibDems are now supporting Labour on the Employment Rights Bill in the Lords. Here come the unlimited payouts…
