A brutal political battle over the deep state’s surveillance powers awaits the Republican Party in the not-so-distant future.
April 20, the deadline for Congress to renew Section 702 of the Foreign Intelligence Surveillance Act (FISA), is fast approaching. The White House is already on board with a “clean extension” of the law, which allows intel agencies to surveil foreigners and potential terrorists without a warrant. However, data belonging to law-abiding American citizens often gets caught in the wide dragnet, leading to misuse and all sorts of privacy and Constitutional concerns. As of now, President Trump is on board with a FISA renewal, according to Republican Arkansas Sen. Tom Cotton.
“President Trump has requested a simple, clean extension, and I support the commander-in-chief on this vital national-security decision,” Cotton, the Senate Intelligence Committee chairman, said in a statement in late February. (By “clean extension,” Cotton means renewing Section 702 without requiring a warrant for the search of U.S. citizen data that gets scooped up.)

The last time FISA was up for renewal, in April 2024, the Republican Party had a golden opportunity to put an end to it, or else seriously reform it, but failed after a bitter political fight tore the party apart. The House nearly added an amendment to require warrants for searches that involved American communications and data, but that effort was shot down in a very tight 212-212 vote. Then-President Joe Biden ended up signing a law that renewed the Section 702 statute for two years. And at the time, numerous Republicans who voted for the two-year FISA authorization couldn’t even explain to the Daily Caller why they did so. It should be noted that Trump was long a critic of FISA abuses. Lest we forget, the law was used against him during the 2016 election to spy on his campaign. The FBI, in its efforts to secretly monitor Trump aide Carter Page, obtained approval from the secret court overseeing FISA by using a document containing fake “dirt” on Trump. Known as the Steele Dossier, the document featured bogus allegations that the Kremlin possessed personal and financial information that compromised Trump.
In 2018, Trump tweeted, “House votes on controversial FISA ACT today. This is the act that may have been used, with the help of the discredited and phony Dossier, to so badly surveil and abuse the Trump Campaign by the previous administration and others?”

And in April 2024, during that last renewal cycle, Trump posted on Truth Social, “KILL FISA, IT WAS ILLEGALLY USED AGAINST ME, AND MANY OTHERS. THEY SPIED ON MY CAMPAIGN!!! DJT” After this post, however, his campaign clarified that the administration believed Section 702 “is vital to keeping the nation safe” and renewing the bill “is a top priority of the administration.”

What will make this upcoming FISA debate extremely contentious — more so than the last — is that the U.S. is now at war with Iran.
The Trump White House will have no choice but to support its renewal, as there are growing fears over Iranian “sleeper cells” or lone wolf actors committing acts of terror in response to America’s war. Already, a mass shooting at an Austin, Texas, bar has left three dead and over a dozen injured. The alleged perpetrator, Ndiaga Diagne, wore a hooded sweatshirt that read “Property of Allah” and a shirt depicting the colors of the Iranian flag, according to authorities. Austin Police Department Chief Lisa Davis said the shooting appeared to be an act of retaliation over the strikes. (RELATED: How Likely Is An Iranian Sleeper Cell Attack On US Soil?)
On the other hand, anti-FISA voices will correctly point out that, during wartime, civil liberties are almost always curbed by the state, and that renewing FISA might accelerate this trend or enable more Constitutional abuse. The United States, in fact, has a long and sordid history of smearing and suppressing anti-war protesters, from the Spanish-American War to Vietnam. So, anticipate very, very dirty political attacks against some FISA’s fiercest critics, including Republican Kentucky Rep. Thomas Massie, who’s facing a primary challenge against a Trump-backed candidate, and Republican Kentucky Sen. Rand Paul.
FISA is a concrete example of why wars abroad can have damaging consequences at home. The last thing the Trump White House will want, especially if this war drags on longer than anticipated, is a small but vocal minority of Republicans who want to reform or outright kill it.
