Republican Senate leadership is eying a hybrid-style debate gambit over the talking filibuster amid detractors’ pressure on the SAVE America Act.
Senate Majority Leader John Thune announced on Feb. 12 that he will bring the legislation to the floor for a “full and robust debate.” His decision comes after President Donald Trump has kept up pressure on congressional Republicans to send the act to his desk for a signature ahead of the 2026 midterm elections.
With the Senate narrowly divided along party lines and some Republicans wary of forcing a talking filibuster, Thune has opted to allow the legislation to proceed to a standard vote with the possibility of extended floor debate rather than triggering a talking filibuster.

Under this approach, the majority can attempt to wear down opposition through continuous debate and enforcement of the Senate’s two-speech rule, which limits each senator to two speeches on the same legislative question per legislative day unless given leave by the chamber.
Because ending debate still requires invoking cloture with 60 votes under Rule XXII, keeping the Senate in continuous session could exhaust the minority’s ability to prolong debate before a final passage vote requiring only a simple majority.
The talking filibuster differs from the modern legislative filibuster because it does not eliminate the Senate’s 60-vote threshold or require changing — or “nuking” — the chamber’s rules. Instead, it requires senators to physically hold the floor to sustain debate and block legislation.
Without either a talking filibuster strategy or 60 votes for cloture, all 53 Republicans and at least seven Senate Democrats would need to support the election integrity legislation for it to pass.

“Mr. President, I cannot guarantee an outcome on this legislation, but I can guarantee you that we are going to put Democrats on the record. That they will be forced to defend their outrageous positions on these issues and explain to the American people why common sense and the Democratic party have parted ways,” Thune said. “Mr. President, Republicans are looking forward to this debate and I look forward to saying much more about the SAVE America Act in the very near future.”

SAVE America Act sponsor Republican Utah Sen. Mike Lee, told the Caller he will be part of the fight as Republicans pursue the strategy in response. (RELATED: John Fetterman Says He Will Never Vote For Current Version Of Election Integrity Law)
“Leader Thune is taking the fight to the Senate floor next week, and I will be there for all of it. I still believe that our best — our only — path to passing the SAVE America Act is by beating a Democrat talking filibuster, as President Trump and millions of Americans have called upon us to do. Whatever happens, we’re going to force Democrats to explain to the entire country why they fear secure elections,” Lee said.
“I urge all concerned Americans to keep up the pressure, keep demanding passage of this vital legislation, and keep fighting for our country,” he added.

A reporter asked Republican Missouri Sen. Josh Hawley about Thune being “reluctant” to move forward with a talking filibuster.
“I’ll let him speak to that,” Hawley said. “I would just say that my view is that this is extremely important. It’s just a myth that to make people actually go and defend their position on the floor is somehow a great break with Senate tradition. That’s not true, that’s how the filibuster has always been implemented. You want to stall something, you can go to the floor. Ted Cruz once read children’s books on the floor, for heaven’s sake. You can ask him about it.”
Hawley argued the Senate was not taking needed action. “That’s how it’s traditionally done, and now Democrats say, ‘we don’t want to do that and if you make us do that you’re breaking the Senate.’ No we’re not, this is how the Senate is supposed to operate, but we should do something, and my concern right now is on a lot of things. We’re just not doing anything,” he said.
