Conservative commentator Megyn Kelly warned on Tuesday that Rep. Alexandria Ocasio-Cortez is setting herself up for a defamation lawsuit.
Speaking on her popular podcast, Kelly noted that Ocasio-Cortez has been defaming President Donald Trump nonstop as of late.

“She has decided to ramp up her anti-Trump rhetoric in a way she has done before, but that could be problematic for her if Trump actually decides to pay some attention,” she said.
As a prime example, she pointed to what the congresswoman said Monday on her “Fight Oligarchy” tour with Sen. Bernie Sanders.
“Donald Trump is a criminal who was found guilty of 34 felony counts of fraud, liable for sexual abuse,” Ocasio-Cortez claimed. “Of course, he’s lying and abusing and manipulating the stock market too. When he talks about rapists and criminals, he should look in the mirror.”

Kelly also pointed to an Instagram post that was published by Ocasio-Cortez prior to Inauguration Day.
“All these journalists are like, ‘Congresswoman, are you going to the inauguration?’ ‘Congresswoman, are you going to the inauguration?’ ‘Are you going to the inauguration,’” she said in the post. “Let me make myself clear: I don’t celebrate rapists, so, no, I’m not going to the inauguration tomorrow.”

Recall that this is the exact sort of freewheeling rhetoric that cost ABC News a whopping $15 million after anchor George Stephanopoulos repeatedly falsely claimed during an interview last March that Trump was “found liable for rape.”
A week after Stephanopoulos made the defamatory remark, Trump filed suit in the U.S. District Court for the Southern District of Florida, arguing that a jury had previously ruled that he was civilly liable for “sexual abuse,” not “rape.”
Months later in December of last year, ABC News finally decided to settle the case out of court.
“ABC News has agreed to pay $15 million toward Donald Trump’s presidential library to settle a lawsuit over anchor George Stephanopoulos’ inaccurate on-air assertion that the president-elect had been found civilly liable for raping writer E. Jean Carroll,” as reported by NPR.
“According to settlement documents made public … ABC will also post a note on its website expressing regret over the claim … and pay $1 million in legal fees to Trump’s lawyer,” the reporting continued.
Continuing her remarks on her podcast Tuesday, Kelly noted that while Ocasio-Cortez has enormous leeway to say what she wants, the leeway doesn’t include calling Trump a “rapist.”
“Stating that he is a ‘rapist’ is a statement of fact which is false and has been rejected by a court of law, and she continues to do it,” Kelly said. “We have gotten so used to people saying the worst things about Trump… but if [you] or anyone you know got called that word, you would absolutely sue her and the standard should not change just because you are Donald Trump.”
Her guest, Steve Deace of BlazeTV, concurred.
“I am 10,000 percent in favor of consequences being ratcheted up comprehensively in the culture at the moment,” he said. “To me, this would be just restitutional for everything they put the president through in the last year and a half… I’m kind of surprised he hasn’t done this already.”
Meanwhile, guest Delano Squires of the Heritage Foundation pointed out how Ocasio-Cortez usually goes to bat for actual rapists and other assorted degnerates.
“AOC is using sort of words like ‘felon’ and ‘criminal’ in a pejorative sense today when she is talking about Trump. Any other time it would be ‘Ban the box,’ ‘we shouldn’t ask people about their criminal history,’ ‘people deserve a second chance,’” he explained.
“So, the left really isn’t against ‘mass incarceration’ – they just want a weaponized legal system so that they can enact vengeance against the people that they do not like,” he added.
This is why, Kelly said as she concluded the discussion, the only recourse available to Trump is legal action.
“He is not going to shut her up unless he does sue her and make an example out of her,” she said. “It would be amazing, but, you know, I do think he has more important things to do at the moment.”
