U.S. Secretary of Education Linda McMahon has finished up her investigation, which lasted around a month, into both the New York Department of Education and the New York State Board of Regents for their ban on Native American imagery when it comes to logos of sports teams.
McMahon paid a visit Friday to Massapequa High School, who have the “Chiefs” as their mascot, to make the announcement that the U.S. Department of Education’s Office for Civil Rights (OCR) discovered that the Board of Regents was in violation of Title VI of the Civil Rights by banning Native American imagery, OurKick reported.
OutKick obtained an email that read, “The Title VI of the Civil Rights Act (1964) prohibits discrimination in federally funded education programs on the basis of race, color, or national origin.”
When the Board of Regents announced their ban in April 2023, it impacted at minimum 133 schools throughout 55 different districts. (RELATED: Oregon Added To DOJ’s Warpath Against Males Being Allowed In Female Sports)
With that being said, McMahon announced that her government entity will be striking the Board of Regents with legal action for being in violation of the law.
“The Trump Administration will not stand idly by as state leaders attempt to eliminate the history and culture of Native American tribes,” said McMahon in an email that was picked up by OutKick. “Rather than focus on learning outcomes, the New York Department of Education and Board of Regents has set its sights on erasing Massapequa’s history – while turning a blind eye to other districts’ mascots that are derived from or connected to other racial or ethnic groups.”
“We will stand with the people of Massapequa until commonsense is restored and justice is served, and until New York comes into compliance with federal law,” the statement continued.
An ultimatum has been issued to each the New York Department of Education and New York State Board of Regents by the OCR to clean up their violations. They have 10 days to do it, or the Department of Justice (DOJ) could come after them.
They are required to:
- Rescind the section of the education regulation that bans using Native American mascots, logos and names in public schools throughout New York
- Issue a memo to every Local Education Agency to inform them that they’re now allowed to use a mascot, logo and name that is consistent with Title IV requirements
- Send apology letters to Native American tribes to acknowledge that the New York State Board of Regents were in violation of Title VI after they discriminated against Native Americans, silenced their voices and tried to erase their history
