President Donald Trump on Tuesday formally nominated Alina Habba, the acting U.S. attorney for New Jersey, for permanent appointment to the position, pending Senate confirmation, as reported by Newsmax.
Habba, who previously served as President Trump’s personal attorney and campaign spokeswoman, has been leading the U.S. Attorney’s Office for the District of New Jersey since March 2025.

During her short tenure as acting U.S. attorney, she has overseen several high-profile legal actions, including the arrest of Newark Mayor Ras Baraka.
In early May, Baraka was taken into custody at an Immigration and Customs Enforcement (ICE) detention center in New Jersey operated by Geo Group, a private prison contractor. He was protesting the facility’s opening when he was arrested on charges of trespassing.

Baraka has since filed a lawsuit against Habba, alleging “false arrest and malicious prosecution,” as well as defamation stemming from public comments Habba made about the incident. The case was later dropped, but the mayor’s lawsuit remains active and is seeking damages.
Despite the legal challenge, President Trump moved forward with Habba’s nomination. If confirmed, she would become the permanent chief federal prosecutor for New Jersey.

Habba addressed her nomination during a Tuesday interview with a conservative podcast host. “Republicans could turn New Jersey red. I really do believe that,” she said. “Hopefully, while I’m there, I can help that cause.”
In her capacity as acting U.S. attorney, Habba has also reportedly initiated investigations into three members of New Jersey’s congressional delegation, though details on those cases remain sealed.
President Trump’s decision to elevate Habba reflects a continued effort to install loyal prosecutors into key federal roles.
Habba previously represented Trump in multiple high-profile legal battles and has been a vocal defender of the administration’s policies on immigration and public safety.
The Senate Judiciary Committee is expected to take up her nomination later this month. If confirmed, Habba would become one of the most prominent Trump-aligned figures to hold a U.S. attorney position in a traditionally Democrat-leaning state.
