SiriusXM’s Megyn Kelly said Wednesday on her “Megyn Kelly Show” podcast that she believes testimony from former White House physician Kevin O’Connor and former Jill Biden chief of staff Anthony Bernal could be enough for the Trump administration to undo some of President Joe Biden’s pardons.
On Sunday, Biden confirmed to the New York Times that he allowed his staff to use his autopen to sign various documents during his presidency — an admission that comes amid a House investigation into the issue. While discussing Bernal pleading the Fifth, Kelly said that while she doesn’t believe the Times report alone would be “enough” to undo Biden’s pardons, subpoenaing O’Connor and others to federal court could lead to a breakthrough in the investigation.
“Well, I don’t think they have enough based on that New York Times article,” Kelly said. “OK, so that article was damning, but I don’t think that was enough to get a pardon reversed. However, I’m interested more in this Comer lane because, you know, they’re running in tandem. So you’ve got the admissions to the New York Times coupled with, they’re going to get Kevin O’Connor’s testimony at some point.”
“I think they’re going to give this guy immunity. They don’t want to put Kevin O’Connor behind bars. They want an answer to the question. And his only other claim of privilege is doctor patient, which can be pierced by a subpoena,” Kelly added. “As a lawyer, I can speak to that. You know very well that you’ve got a lawyer-client privilege you have to uphold, but if you get subpoenaed to federal court, it’s a different story. So this guy’s going to be forced to talk.”
Just before leaving the White House in January, Biden announced a wave of pardons for a number of individuals, including high-profile figures like former White House Chief Medical Advisor Anthony Fauci, Gen. Mark Milley and other members of his own family. In addition to the high-profile pardons, the former president also commuted the sentences of nearly 1,500 criminals — including three Democratic politicians and several other public officials. Questions about Biden’s mental fitness during his presidency began circulating among Democrats following the release of a book by CNN’s Jake Tapper and Axios’ Alex Thompson, which cited sources who raised concerns about the president’s cognitive health. While Republicans have long questioned Biden’s mental state, House Oversight Committee Chair James Comer quickly called for former Biden staffers and O’Connor to be brought in for questioning.
“My only question is whether, like, if you get O’Connor and possibly Bernal, if they give him immunity too, because, again, they’re not interested in putting him behind bars,” Kelly said. “They want to get the story. Whether we could wind up with testimony from two of these top guys saying, ‘Yes, I was told to lie about his self. Yes, there were civilians.’”
“If you’ve got those guys eventually on record saying that they were in charge of the presidency and they were told a lie. Now we’re talking about possibly undoing, I mean, forget the pardons. We could go well beyond that,” Kelly said.
Both O’Connor and Bernal have pleaded the Fifth before lawmakers, refusing to answer questions about their time in the White House under Biden and the former president’s mental fitness.
In his interview with The Times, Biden said he allowed staff to use his autopen because he was “granting clemency to so many people,” adding that he personally approved each pardon and commutation.
From December 2024 to January, Biden signed just one pardon by hand, for his son Hunter, while issuing the use of the autopen for a handful of other pardons and commutations.
