
A California pastor has warned that parents in the state will need to move out immediately if a newly proposed bill makes it into the books.
The bill, AB 495, would amend sections of the California Education Code, Family Code and Probate Code to expand who’s eligible for a caregiver’s authorization affidavit, according to Sacramento station KCRA.
According to the bill’s supporters, it’d basically allow parents to choose any trusted adult to temporarily care for their child by signing a form called a Caregiver’s Authorization Affidavit. The chosen adult would be authorized to make decisions about the child’s school and medical care.
Meanwhile, the parents wouldn’t have to give up their parental rights — instead, the signing of the form would create a short-term guardianship.
The purpose of the bill, according to California state legislator Celeste Rodriguez, is to provide short-term, temporary guardianship for children whose parents are either detained or deported by immigration officials.
“I am working on AB 495 with trusted legal attorneys and children’s advocates to help families facing family separation make caregiving arrangements,” she explained to KCRA.
But critics say the bill is a “kidnapper’s dream.”
How so? Because the bill also expands who’s eligible to fill out a Caregiver’s Authorization Affidavit from just verified “relatives” to so-called “nonrelative extended family member[s].”
“The updated affidavit also states that a ‘parent’s signature or signature of the court is not required,’” The Lion reports.
Speaking with conservative radio show host Glenn Beck this week, California Pastor Jack Hibbs warned that it’d allow ANYONE to pretty much kidnap your kids from school.
“Any individual can go to the website, print out the affidavit from their home,” he said. “They’re going to be asked a question: Did you attempt to reach the parents or the custodians or guardians of this child? Yes or no. Whatever they checked, then they sign their name.”
“No address is required. There’s no driver’s license required. There is no Social Security number required. There’s no phone number required. The person checks the box. Signs the name. And then writes down the child’s name that they are withdrawing from the school,” he added.
Hibbs continued by describing a theoretical scenario.
“So theoretically, Glenn, somebody could be down the street from your grandkids or your grandchildren,” he said. “And they can see you go to work at a certain time of day. They know your kid goes to a certain school. They can go to that school with that affidavit. Extract your child out.”
“Here’s the punch line: Because it’s an affidavit, the school cannot refuse the requester of that child. When you, Glenn, go back to pick up your child at the end of the day, the school is under no obligation to tell you who it was. Or where they went,” he added.
Beck got the message loud and clear.
“[I]f California passes AB 495, you need to move out IMMEDIATELY!” he wrote on his website.
But it’s not just the pastor speaking out. So are others across California.

“It doesn’t matter what the author intends, it matters what’s inside the bill,” California Family Council president Jonathan Keller told The Lion. “AB 495 is poisonous. It will destroy families and children. We will not back down, we will not shut up, and we will not stand aside.”
“With just one sheet of paper from the internet, California wants to let someone who is not related to your child remove her from school, enroll her in any other school in the state and authorize any medical treatment without the parent’s knowledge or consent,” attorney Nicole Pearson added.
“This is not fearmongering. I am not being hyperbolic. It’s stated right here in the caretaker’s affidavit pulled directly from the bill,” she continued.

Right-wing legislators have also taken note of the bill.
“It does not just pertain to children who are here with undocumented parents that have been detained,” state lawmaker Carl DeMaio told station KGO.
“Instead, it applies to all children, in any circumstance, where a complete stranger can simply claim authority over a child, and then start making all sorts of decisions for the child’s welfare, for health treatment. This is just insane,” he added.
