
Border Patrol agents fatally shot a suspect Wednesday after he fled a checkpoint near El Paso in a stolen vehicle, led law enforcement on a lengthy pursuit, and fired at officers and civilian vehicles along Interstate 10.
Authorities identified the suspect as 33-year-old James Douglas McMillan of Greenfield, Wisconsin.
According to officials, the incident began around 10:30 a.m. when McMillan approached a U.S. Border Patrol checkpoint along Interstate 10 in Sierra Blanca, a community located east of El Paso.

During the inspection, a Border Patrol drug-detection K-9 alerted to the vehicle McMillan was driving. Agents then directed him to pull over for a secondary inspection.
Instead of complying, McMillan accelerated away from the checkpoint and fled the area, prompting a pursuit by Border Patrol agents and other law enforcement agencies.
Authorities said McMillan began firing a weapon out of his vehicle window while driving, targeting officers and other vehicles on the roadway.
The pursuit continued for approximately 70 miles as law enforcement units followed the suspect along Interstate 10.

Multiple agencies joined the chase, including Texas Department of Public Safety troopers, deputies from the Culberson County Sheriff’s Office and the Hudspeth County Sheriff’s Office, and agents from the Border Patrol Tactical Unit, commonly known as BORTAC.
Officials said McMillan fired repeatedly during the pursuit, directing gunfire toward DPS troopers, other responding law enforcement officers, and civilian vehicles traveling on the interstate.
According to the Texas Department of Public Safety, troopers eventually used a precision immobilization technique maneuver to stop the suspect vehicle.
The maneuver successfully halted the vehicle, bringing the chase to an end. After the car was stopped, McMillan remained inside and refused to surrender.
Authorities said the suspect then barricaded himself inside the vehicle.
“McMillan barricaded himself in his vehicle and eventually pointed his weapon towards officers – officers then discharged their weapons,” Texas DPS said.
Officers fired at McMillan after he pointed the weapon in their direction.
He was pronounced dead at the scene.
Officials confirmed that McMillan had been driving a vehicle that had been reported stolen from Arizona.
Despite the prolonged pursuit and the suspect firing multiple shots during the incident, authorities said no law enforcement officers or civilians were injured.
Law enforcement agencies involved in the pursuit and response included Texas Department of Public Safety troopers, Border Patrol agents, the Culberson County Sheriff’s Office, the Hudspeth County Sheriff’s Office, and members of the Border Patrol Tactical Unit.
Authorities said McMillan’s actions created a dangerous situation for both officers and motorists traveling along the interstate.
The incident began when McMillan attempted to pass through the Sierra Blanca checkpoint, one of several federal inspection points located along major highways near the southern border.
After the K-9 alert and the instruction for a secondary inspection, McMillan fled and began firing during the chase, according to officials.
Law enforcement returned fire during the pursuit before ultimately stopping the vehicle with the PIT maneuver.
After the vehicle was immobilized and the suspect barricaded himself inside, officers confronted McMillan when he pointed a weapon at them.
At that point, officers discharged their weapons, resulting in McMillan’s death.
Authorities confirmed that the incident concluded without injuries to responding officers or members of the public.
Investigations into the shooting and the circumstances surrounding the pursuit are typically reviewed following incidents involving use of force by law enforcement.
