The pardons were part of a larger group of controversial actions taken by Biden before leaving office, reportedly out of concern that incoming President Donald Trump would pursue prosecutions against the individuals involved.
President Trump has been an outspoken critic of Fauci and Milley, accusing them of undermining his policies during the COVID-19 pandemic in 2020 and in the aftermath of the January 6, 2021, Capitol incident.
Oversight Committee Chair James Comer (R-KY) confirmed that the panel will seek further documentation from the former administration to determine whether Biden, 82, was fully aware of the pardons when an autopen was used to sign them.
The committee is looking into whether aides, rather than Biden himself, authorized the pardons.

Biden has denied claims that he was not lucid during the signing process, insisting he “signed off on the standards” for the pardons, though he acknowledged in a June interview that he did not always know the specific recipients.
That statement has fueled Republican efforts to challenge the validity of the pardons, particularly those granted to Fauci and Milley for actions during Trump’s first term.
President Trump responded to news of the investigation on Truth Social, calling it “great news” and signaling support for Comer’s probe.

Milley, who served as Chair of the Joint Chiefs of Staff for most of Trump’s first term, remained in that position under Biden.
He has publicly called Trump a “fascist” and a “wannabe dictator,” comments reported by the Monitor.
Milley first clashed with Trump during the 2020 Black Lives Matter protests, when he refused an order to deploy active-duty military forces into U.S. cities experiencing unrest, including Minneapolis, Minnesota, and Portland, Oregon.
Fauci, who served as Director of the National Institute of Allergy and Infectious Diseases, became a prominent figure during the COVID-19 pandemic.
After retiring, he distanced himself from the Trump administration, with Trump repeatedly calling him a “total disaster” for his handling of the crisis.

The pardons of Fauci and Milley were not the only late-term actions under scrutiny.
Biden also granted clemency to several members of his own family, including his son Hunter Biden, his brother James Biden, and James’s wife Sarah Biden.

Comer has previously linked the three to business dealings with foreign oligarchs.
According to Comer, those transactions involved a complex network of companies that ultimately funneled a $40,000 “loan repayment” directly to Biden.
The Oversight Committee’s investigation will examine whether the pardons were legally and properly executed, as well as the decision-making process behind them.
The probe is expected to focus heavily on whether the use of an autopen in Biden’s final days in office compromised the legitimacy of the actions taken.
