One of disgraced Hollywood mogul Harvey Weinstein’s accusers stormed out of the courtroom in tears during the second day of his retrial.
Appearing in a Manhattan court on Friday for the second day of cross-examination, former “Project Runway” production assistant Miriam Haley was roughly 30 minutes into her testimony when Weinstein attorney Jennifer Bonjean began pressing her on what she’d worn the night Weinstein forcibly performed oral sex on her.
According to The New York Times, Haley said that Weinstein invited her to his apartment on July 10th, 2006, to “say hi” ahead of their scheduled attendance the following day of a premiere in Las Vegas.
“Shortly after she arrived that afternoon, July 10, 2006, Ms. Haley testified, he backed her into a bedroom, forced her onto a bed, held her down and forcibly put his mouth on her vagina,” the Times notes.

During questioning on Friday, Bonjean asked Haley if she’d undressed herself during this incident.
“I didn’t take my clothes off!” she snapped back. “He was the one who raped me, not the other way around.”
This prompted Bonjean to reply, “That’s for the jury to decide.”
This was the final straw for Haley.
“No, it’s not for the jury to decide when it’s my experience and he did that to me,” she angrily responded, according to the New York Post.
“Don’t tell me I wasn’t raped by that f–king a–hole!” she added as she broke into tears and dizzily rushed out of the courtroom, almost running into the defense where Weinstein was seated.
The outburst prompted Judge Curtis Farber to order a 10-minute recess during which the jury was removed from the courtroom.
Upon everybody’s return 10 minutes later, Bonjean continued asking Haley about the clothes she’d worn on July 10th, 2006, and she in turn continued maintaining she wasn’t the one who took them off.
“I did not remove my clothes,” she said. “I was on my period. I did not remove my clothes.”

This week’s testimony from Haley marked the second time she’s testified against Weinstein. The first time was in 2020, when she testified in his first trial. That case led to a guilty verdict that was later overturned early last year when the New York State Court of Appeals found that the judge in the case had made improper rulings.
“We conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose,” the court said in a 4-3 decision.
“The court compounded that error when it ruled that defendant, who had no criminal history, could be cross examined about those allegations as well as numerous allegations of misconduct that portrayed defendant in a highly prejudicial light,” the decision continued.
Despite the case being overturned, Weinstein has remained behind bars on separate rape and sexual assault charges that he was convicted on in Los Angeles in 2022. He’s serving a 16-year sentence as per the charges.

Plus, Weinstein was reindicted on the New York charges in late 2024. But there is one slight difference this time around.
“Weinstein’s retrial will resemble the original proceedings in certain key ways. He will be retried on charges that he forcibly performed oral sex on Haley, the former ‘Project Runway’ production assistant, in 2006, and raped [Jessica] Mann, the former aspiring actress, in 2013,” NBC News notes.
“But there will be an important addition. Weinstein faces an additional count of first-degree criminal sexual act based on an allegation from an unnamed woman who was not part of the first trial. The woman alleges he forcibly performed oral sex on her in a Manhattan hotel in 2006,” according to NBC.
Also, Weinstein is no longer being held on Rikers Island. Because of his health conditions, he’s been transferred to Bellevue Hospital, where he’ll remain until his second trial concludes.
