Erika Kirk Addresses Whether She’ll Seek Death Penalty For Husband’s Alleged Killer

Turning Point USA CEO Erika Kirk said she would not personally seek the death penalty for the man accused of killing her husband.

More than a month after his arrest, the Justice Department has yet to prosecute Tyler Robinson for allegedly killing conservative activist Charlie Kirk as his defense team reviews what prosecutors called “voluminous” evidence in the Utah capital murder case. In an exclusive interview with “Jesse Watters Primetime,” host Jesse Watters asked Charlie’s widow Erika Kirk whether she would seek the death penalty for the alleged killer.

“I do not want this man’s blood on my ledger when I stand before the Lord. I want the government to decide. It’s Biblical, too. Justice will ultimately be served,” Erika Kirk told Watters.

Erika Kirk publicly forgave her husband’s alleged killer during a memorial service for the Turning Point USA founder, saying she refused to answer evil with hatred. Police arrested Robinson, 22, about 33 hours after Kirk was fatally shot while hosting a “Prove Me Wrong” event at Utah Valley University.

Prosecutors in Utah County charged Robinson with aggravated murder, felony firearm discharge causing serious injury, obstruction of justice, witness tampering, and committing a violent offense in front of a child.

Murder itself is not a federal crime, but certain killings fall under federal jurisdiction, according to the FBI. The delay in charging Robinson does not mean the Justice Department will avoid pursuing the case, Heritage Foundation senior legal fellow Zack Smith told the Daily Caller News Foundation, noting that “there is probably a federal hook for the Justice Department to take jurisdiction,” such as terrorism, hate crimes, or firearm violations.
