EXCLUSIVE: GOP Illinois Rep. Introduces Bill To Reassert Biological Reality Into Federal Law

Republican Illinois Rep. Mary Miller will introduce legislation Tuesday to affirm biological definitions of sex under Title IX as strictly biologically male or female, the Daily Caller first learned.

Miller will reintroduce the “Safety and Opportunity for Girls Act” on August 26, coinciding with the 105th anniversary of the 19th Amendment.

The legislation seeks to address both women’s sports and locker room issues, while also clarifying the definition of sex under Title IX of the Education Amendments of 1972, according to a press release obtained by the Daily Caller.

Miller told the Caller on Monday that her bill aims to restore Title IX’s original purpose and prevent Democrats from weakening women’s rights by allowing biological males to participate in girls’ sports and access their private spaces.

“The Left is erasing decades of progress for women by forcing girls to compete and share private spaces with men. We cannot let this continue,” she said in a statement. “On the 105th anniversary of the certification of the 19th Amendment, my bill will secure Title IX’s original purpose of protecting biological girls’ sports, privacy, and opportunities.”

The bill will be reintroduced with an updated definitions section that explicitly defines male, female and sex as biologically determined, according to the legislation.

The term “female” refers to someone who naturally has, or would have, a reproductive system that “at some point produces, transports and uses eggs for fertilization,” the bill states. The term “male” refers to an individual who naturally has, or would have, a reproductive system that “at some point produces, transports and uses sperm for fertilization.”

The term “sex,” when applied to an individual, refers to either “male or female, as biologically determined.”

Miller’s bill is co-sponsored by several Republican representatives: South Carolina Rep. Nancy Mace, Tennessee Rep. Diana Harshbarger, Virginia Rep. Ben Cline, Tennessee Rep. Tim Burchett, Colorado Rep. Lauren Boebert, Wisconsin Rep. Glenn Grothman and South Carolina Rep. Sheri Biggs.

The bill would codify President Donald Trump’s executive order (EO) titled “Defending Women From Gender Ideology Extremism And Restoring Biological Truth To The Federal Government.” Trump’s directive defines male and female as “immutable biological” categories and distinguishes “sex” from “gender identity.”

Trump stated in the order that his administration will safeguard women’s rights and uphold freedom of conscience “by using clear and accurate language and policies that recognize women are biologically female, and men are biologically male.”

Miller’s bill also defines “sex-segregated” and makes clear that Title IX permits schools to maintain locker rooms, athletic or academic programs and sex-segregated bathrooms.

“The term ‘sex-segregated’ means limited to or separated by sex,” the legislation reads.

The bill also prevents the Department of Education from forcing schools to remove sex-segregated facilities or programs in order to get federal funding.

Miller will reintroduce the bill with support from the organizations Concerned Women for America, Moms for America, American Principles Project, Moms for Liberty, Parents Defending Education, Family Research Council and Family Policy Alliance. Miller previously introduced the “Keep Our Girls Safe Act” legislation in March which would fully codify Trump’s order, “Keeping Men Out of Women’s Sports.”

The bill “ensures public schools comply with federal mandates to protect female-only spaces or lose federal funding,” a March press release stated.

The bill directs the federal government to withdraw funding from any public school in the U.S. that denies women and girls access to female-only spaces, according to a press release.
