‘Far Cry From Reality’: Fox News’ Will Cain Gives Dem Rep Reality Check On Trump Admin’s Deportation Of MS-13 Member

Fox News host Will Cain confronted Democrat Florida Rep. Maxwell Frost Monday on his claims that President Donald Trump violated an MS-13 member’s due process.

Frost is among four Democrat representatives to visit Kilmar Abrego Garcia in El Salvador following his deportation in March as they argue that he should be returned to the U.S. During a live interview, Cain reminded Frost that Garcia is an illegal immigrant, is part of a foreign terrorist organization and has a criminal record.

“MS-13 has been designated as a foreign terrorist organization, has it not?” Cain asked, with Frost confirming that fact. “Okay, it has. And there is an ordered removal of Abrego Garcia by a district court of Maryland. The U.S. district court wrote, ‘Although Abrego Garcia was found removable, the immigration judge granted him withholding of removal to El Salvador in an order dated October 10, 2019.’ So he was ordered removable.”

“He had a protected status as you just read and if he is to be deported, there is a process that he needs to go through and that’s the whole situation here,” Frost said. “I’m not here to litigate even a very specific person, I’m here to talk about the fact that he represents a very big problem with this administration that they have no problem scooping somebody up based on tattoos and vibes and sending them to a foreign country’s prison and then have the Commander-in-Chief taking about sending homegrowns next.”

Cain scoffed at the suggestion that Trump intends to deport U.S. citizens from their native country. “He is an illegal alien, he is an alleged gang member of a foreign terrorist designated organization and he was ordered removed. That would seem, at level, an element of due process that certainly distinguishes him from the average American citizen,” Cain continued. “And you are making a very scary argument to Americans today. You are suggesting to Americans [that] if [Trump] can remove this man, the details of which we just walked through, you’re suggesting that he can remove you. And that seems like a pretty far cry from reality.”

Immigration and Customs Enforcement (ICE) agents arrested Garcia, who unlawfully entered the U.S. in 2011, on March 12 and deported him to his native country, according to court documents. After the Trump administration admitted that Garcia’s deportation was a clerical error, they have maintained that Garcia should remain in El Salvador due to court documents detailing his association with MS-13 and due to his past deportation orders in 2019.

A judge granted Garcia protected status known as “withholding of removal” in October 2019 after determining that he would likely be persecuted by gangs if deported back to El Salvador, according to the court documents.

U.S. District Judge Paula Xinis, an Obama-appointed judge, ordered the administration to quickly effectuate Garcia’s return to the U.S. Supreme Court Chief Justice John Roberts temporarily blocked the judge’s order in an April 7 ruling, stating that the U.S. cannot “compel El Salvador to follow a federal judge’s bidding.”

The high court later ruled that the administration should facilitate the return of Garcia from El Salvador, though El Salvadoran President Nayib Bukele confirmed that he will not return Garcia back to the U.S. during an April 14 visit to the Oval Office.

Along with Frost, Democrat Reps. Robert Garcia of California, Yassamin Ansari of Arizona, Maxine Dexter of Oregon and Sen. Chris Van Hollen of Maryland also traveled to El Salvador.
