Former Special Counsel John Durham insist there is no evidence in case against James Comey

An ABC News report indicates that former Special Counsel John Durham “undercut” the case against James Comey.

Durham, who was appointed during President Donald Trump’s first term, allegedly spoke to prosecutors in August and claimed that his probe into the FBI investigation turned over no evidence to support the Department of Justice’s false statements or obstruction charges against Comey.

“Federal prosecutors in Virginia met remotely with Durham in August to understand the findings of his investigation, according to sources familiar with the meeting, and his conclusions raise the prospect that Durham — who was once elevated by Trump and other Republicans believing he would prosecute high-level officials involved with the investigation of the president’s 2016 campaign — could now become a key figure aiding Comey’s defense,” the outlet reported.

Sources familiar with the meeting also claim that prosecutors met with “a team of lawyers at the U.S. Attorney’s Office in Washington, D.C., who had investigated Comey for years” but could not find any offenses with which to charge him.

Prosecutors eventually concluded their investigation and declined to charge Comey, citing the lack of findings in both of the aforementioned investigations. They said in their declination letter that no probable cause existed to move forward.

But Lindsey Halligan disagreed, rejecting the letter and opting to bring a three-count indictment against the former FBI director. Last month, a grand jury indicted Comey “on two charges of making a false statement to Congress and obstruction,” but rejected the third charge of additional false statements.

While Durham and the “team of lawyers” may believe there is no case against Comey, President Donald Trump’s personal attorney-turned-enemy, Michael Cohen, believes that the former director may very well be found guilty.

“Do any of us actually really know whether or not Comey is or is not guilty of the charges? I know that they parade out all of these pundits, they have the great titles in the chyron, ‘former prosecutor,’ yada yada, ‘former FBI.’ Who’s seen a single document that’s in the possession, right now, of the DOJ? The answer is nobody,” Cohen said to an MSNBC panel. “Who has the crystal ball? Still nobody.”

“I will tell you, from my investigation, which I used Brian Karem, who’s a 30-year White House correspondent, to speak to people inside government since they wouldn’t talk to me. I’ve learned that Comey was very much involved in the Russia investigation in a very negative way. And chances are, this DOJ has every single email, every text message, every communication. I believe, likely, he will be found guilty,” he charged, much to the chagrin of the panel.
