Fox News legal analyst Gregg Jarrett said Thursday on Fox News’ “Hannity” that the U.S. Supreme Court’s “bright green light” for the Trump administration to continue deporting illegal migrants could have an effect on illegal migrant Kilmar Armando Abrego Garcia’s case.
The Supreme Court ruled in favor of the Trump administration on Monday, allowing the continuation of illegal migrants to be deported to countries not specified in their removal orders after a lower court attempt to block them. While discussing the potential release of Abrego Garcia by a federal judge, Fox’s Sean Hannity asked Jarrett where the illegal migrant’s case could legally “go” since being brought back to the U.S. after being deported.
“Well, for now, Garcia is in a federal jail as two different federal courts are wrangling over what’s going to happen next. In Tennessee’s, of course, charged, as you mentioned, with human smuggling that allegedly includes trafficking children and abusing women, which is horrific,” Jarrett said. “Yet the magistrate there ordered his release because she said, ‘Oh, gee you know, he’s not a flight risk. He’s not a danger to the community.’”
“I find that hard to believe, given the gravity of the charges, his suspected ties to murderous gang MS-13, that’s in the indictment, and the fact that he was here illegally, which means he has every motive to flee,” Jarrett added. “In the meantime, Maryland, where Garcia’s wife lives, a different judge is considering a request to have a move there, even though she has no jurisdiction over anything.”
In March, the Trump administration deported Abrego Garcia to El Salvador, with Democrats later claiming the illegal migrant hadn’t received proper “due process.” Despite the Department of Justice (DOJ) releasing a dossier detailing Abrego Garcia’s alleged ties to MS-13 and other allegations, including human trafficking, he was returned to the U.S. on June 6. According to the DOJ, Abrego Garcia faces criminal charges for allegedly transporting illegal migrants across the country, with Attorney General Pam Bondi accusing him of making over 100 smuggling trips.
Since his return, his lawyers have asked the court to release him from jail, suggesting he may now qualify for asylum due to his incarceration in El Salvador’s mega-prison. On Monday, U.S. Magistrate Judge Barbara Holmes denied the DOJ’s request to keep Abrego Garcia in detention ahead of trial.
“On top of it all, we’re kind of getting mixed messages. A DOJ spokesperson said, ‘Oh we’re gonna prosecute, we’re gonna try Garcia.’ But then a DOJ lawyer told a judge ‘No, we’re moving ahead to deport him when he is released,’ but he offered no timetable. So this thing is as clear as mud,” Jarret said.
“But one thing’s for sure. The U.S. Supreme Court ruling this week gives the Trump administration a bright green light to resume deporting migrants to countries other than their own and with limited notice. I think maybe that has altered the calculation in the Trump administration. We’ve got to go ahead. Let’s just get rid of this guy once and for all,” Jarrett said.
In its case to the Supreme Court, the Trump administration argued that the lower court’s order interfered with its ability to deport “some of the worst of the worst illegal aliens,” adding that the U.S. is “facing a crisis.”
