As we told you earlier, President Trump was at the Supreme Court this morning and had a seat to listen to arguments in the birthright citizenship EO case.
Cue up the Democrat and media (as always, pardon the redundancy) alarm about “separation of powers”:
If President Trump attends the Supreme Court’s oral arguments tomorrow on his birthright citizenship executive order like he says he will, he would be the first sitting president on record to do so. Presidents have avoided attendance in part to honor the separation of powers.

Rep. Susie Lee, who was so triggered by news of Trump attending a SCOTUS hearing, posted a now deleted F-bomb laden rant. Lee explained it this way:
Clearly my language touched a nerve — my nerve was touched by the attacks on our Constitution and its separation of powers. I took an oath to protect and defend it.

The Justice Department’s Harmeet Dhillon quickly poured cold water on the Left’s “separation of powers” meltdown about Trump being at the SCOTUS hearing:
There’s literally a chair set up at SCOTUS for our presidents to sit in for oral argument. Your separation of powers nonsense is more imitation pearl-clutching hauteur. https://t.co/unVfZPgD9v

Dhillon quote tweeted this from the @NationalMallNPS:
Per @NationalMallNPS: “Representatives of the press are seated in the red benches along the left side of the Courtroom. The red benches on the right are reserved for guests of the Justices. The black chairs in front of those benches are for the officers of the Court, visiting… https://t.co/vtl6CWu5NS pic.twitter.com/WQytXSQ1l5

“Representatives of the press are seated in the red benches along the left side of the Courtroom. The red benches on the right are reserved for guests of the Justices. The black chairs in front of those benches are for the officers of the Court, visiting dignitaries, and include a special chair for the President of the United States, although the President’s attendance is rare and limited to important ceremonial occasions.”
You’re correct—the National Register of Historic Places nomination form for the Supreme Court building (from NPS) does describe one of the black chairs in the courtroom as a “special chair for the President of the United States,” among those for officers and dignitaries. I was…

It’s not known if Trump sat in the specific chair described above for today’s hearing.
The bottom line is that the Dems have been trying to make it sound like it was completely improper for the president to be there, which is not the case.
That’s not a policy. It’s an observation of how past presidents have used it.
There is no precluding a president from attending oral arguments. Find something else to freak out over.

Oh, they will find something else to freak out over.
One of my colleagues:
“Supreme Court justices sit in Congress and listen to the president give their SOTU address. What’s the difference?”
— 🇺🇸 Mike Davis 🇺🇸 (@mrddmia) April 1, 2026
Members of Congress also go to the White House for events on occasion, but we’re supposed to believe that Trump attending a SCOTUS hearing is another constitutional crisis. The Left didn’t think Chuck Schumer standing outside SCOTUS issuing threats was a problem, however. Go figure.
