‘Just Vindictive’: Alan Dershowitz Says Case Against Diddy Is ‘Not A Strong Case’

Attorney Alan Dershowitz ripped the judge in the trial of Sean “P. Diddy” Combs Wednesday, accusing him of being “vindictive” by denying the rapper bail even though the federal government lacked a “strong case.”

A jury convicted Combs on two counts of transportation to engage in prostitution, while acquitting him on two counts of sex trafficking and one count of racketeering Wednesday. “In my view, this guy… was convicted of something that’s not a crime: Two counts of interstate travel for immoral purposes, for purposes of engaging in prostitution,” Dershowitz said. “It wasn’t even prostitution, it was, you know, fancy living in exchange [for] sex. Look, he may have done other terrible things, but that’s now when he was convicted of, and so this judge just now denied him bail. On what grounds? This guy’s not gonna run anywhere. It’s absurd. He has one of the nicest houses, I pass it by all the time, it’s right near, not far from my little tiny condo in Miami, Florida. He lives on Star Island. This property’s probably worth 40 or 50 million dollars. He has two properties on the most expensive island, one of the most expensive islands in the world.”

“He is one of the most recognizable people. This decision by this judge was just vindictive. He didn’t like the verdict,” Dershowitz said. “He thought there should be a conviction, and so he’s gonna probably sentence him to a little bit of time in prison. He can’t sentence him to do a lot of time, but he’ll probably send him to a little bit of time in prison in excess of the year he’s already spent for having had bail denied, but he’s gonna do it. He’s gonna come up with some pretense. ‘Oh, the appellate issues are not good appellate issues.’ Yeah, they are good appellate issues. I can win this appeal. This is not a strong case. You don’t get people convicted for consensual transactional sex. Moreover, what the jury saw was not traditional transactional conventional sex. It was videotapes of him beating up mercilessly his girlfriend. It’s a terrible thing, but it’s not relevant to whether he crossed state lines.”

Combs is set for a sentencing hearing on July 8, CNN reported. Combs also faces multiple civil suits accusing him of rape.

Dershowitz later repeated his belief that an appeal could overturn the rapper’s conviction.

“I think a good appellate lawyer could win this appeal. There are lots and lots of very good appellate issues and lots of good lawyers in the case, who could, I think, successfully win this appeal. Also that’s an issue that the trial court has no special competence on,” Dershowitz said. “It’s the court of appeals that has special competence. Trial judges often say that there are no good appellate issues because if there’s an appeal and it’s reversed, the judges gets a flunking grade. He’s failed.”
