FBI Director Kash Patel has alleged that prior FBI leadership obtained his phone records as well as those of current White House Chief of Staff Susie Wiles in 2022 and 2023, a development that he says ultimately led to the Jack Smith special counsel investigation into then former President Donald Trump.
The allegation surfaced during a live exchange between Fox News anchor Bret Baier and correspondent David Spunt.
“FBI Director Kash Patel out with an allegation that the prior FBI, FBI obtained his phone records and not only his. What can you tell us about that?” Baier asked.

Spunt responded that the information had emerged within the last hour.
“Bret, this has been breaking in the last hour or so,” Spunt said.
“We are told that, according to cash, but tell the FBI director the prior Bureau leadership, obtained his phone records and phone records to current White House Chief of Staff, Suzy Wiles, back in 2022 and 2023 This eventually led into the Jack Smith special counsel investigation into then former President Donald Trump.”
Spunt noted that some of the records obtained were limited in scope.

“We’re told that some of these records are just toll records which don’t have specific information other than times and dates,” he said. “They don’t have the actual content of calls.”
According to Spunt, additional concerns have been raised regarding interactions between FBI agents and Wiles’ legal representation.
“But two sources in the FBI say that Susie Weil’s attorney agreed to be recorded by FBI agents in 2023 she did not agree,” Spunt said.
“We reached out to her for comment.”
In a statement provided to Fox News, Patel characterized the situation in strong terms.
“FBI Director Patel, in a statement to Fox News, calls this outrageous and deeply disturbing,” Spunt reported.
The reported actions by prior FBI leadership are said to have occurred before Patel assumed his role as Director. The acquisition of toll records — which include call times and dates but not the substance of conversations — is a standard investigative tool, though questions have now been raised about the circumstances surrounding their use in this case.
Spunt also reported personnel consequences tied to the incident.
“And I will add Bret that we are told at least 10 Bureau employees have been fired just today over this incident, with more potentially to come,” he said.
