Sen. Mike Lee, R-Utah, defended the SAVE America Act during remarks addressing criticism that the legislation is unnecessary, arguing that existing laws alone are not enough to prevent or address illegal voting.

Lee said opponents of the bill have pointed to the fact that non-citizen voting is already prohibited under current law, but he rejected that argument as flawed, comparing it to other areas of law enforcement where enforcement mechanisms are required.

“They have instead said we don’t need the SAVE AMERICA Act because, and this one is a kicker, because it’s already against the law,” Lee said.

He continued by explaining his comparison to traffic enforcement.

“That Mr. President under these circumstances, is analogous to saying we don’t need a law allowing police to issue citations and monitor traffic at intersections governed by a stop sign, because it’s already against the law in our state to run a stop sign.”

Lee said the absence of enforcement tools would make such laws ineffective, even if violations remain illegal.

“And even though police officers under the Status Quo are prohibited from monitoring intersections and taking note of when someone runs a stop sign. We know that people don’t run stop signs because it’s against the law.”

He argued that this comparison reflects the current debate surrounding election laws and enforcement.

“That is directly, closely, tightly, analogous to what they’re saying here.”

Lee continued by describing how the argument against the SAVE America Act relies on existing prohibitions without addressing enforcement challenges.

“We don’t need a law making our laws prohibiting non citizen voting because it’s already against the law.”

He said that position fails to account for the difficulty of identifying and prosecuting violations.

“And we take that defiant, illogical, absurd position, even knowing that we’ve made it impossible to detect and therefore prosecute and punish anyone who breaks that law.”
