Republican Rep. Nancy Mace of South Carolina announced Wednesday she is introducing a resolution to expel Democratic Rep. LaMonica McIver of New Jersey from the U.S. House of Representatives.
The move comes in response to the Justice Department’s decision to formally charge McIver with allegedly assaulting a federal law enforcement officer.
“Assaulting federal agents is a crime, plain and simple,” Mace wrote in a statement posted to X.
“No one is above the law. The American people deserve better.”

According to Axios, Mace will not immediately force a vote on the expulsion resolution but instead is referring the matter to the House Ethics Committee for review.

The charges stem from an incident earlier this month outside a U.S. Immigration and Customs Enforcement (ICE) detention facility in Newark, New Jersey.
Federal prosecutors allege that McIver elbowed an ICE officer while protesting enforcement operations at the location. Body camera footage reportedly captured the physical contact.
McIver has denied the allegation and instead claims she was assaulted during the encounter.
Responding to Mace’s resolution on X, McIver wrote, “In the South I think they say, ‘bless her heart.’”

The incident has drawn swift reaction from House Republicans, who have launched a series of coordinated disciplinary efforts in addition to Mace’s resolution.
Rep. William Timmons, also a South Carolina Republican, introduced a resolution to censure McIver and called for a formal investigation by the House Ethics Committee.
Timmons stated that elected officials “must be held to the highest standard when it comes to conduct, particularly when it involves federal law enforcement.”

Georgia Rep. Buddy Carter, who is currently running for the U.S. Senate, also introduced a resolution aimed at removing McIver from her committee assignments.

The House Ethics Committee has not publicly commented on whether it will take up the investigation or when a decision might be made.
Mace’s resolution does not carry the force of removal unless a two-thirds majority in the House votes to expel, which would require significant bipartisan support.
This is not the first time a member of Congress has faced calls for expulsion based on alleged conduct involving law enforcement.
However, expulsions are rare and historically have required a high threshold of evidence and bipartisan agreement.
McIver has served in Congress since 2023 and has been a vocal critic of federal immigration enforcement policies.
The Justice Department has not released further information beyond the initial charging documents, and no court date has been publicly confirmed as of Wednesday evening.
The case is expected to draw increased scrutiny as it progresses through both the legal system and the House disciplinary process.
