A Tennessee woman is facing child endangerment charges after her two children, ages 2 and 4, ate her legally purchased THCA gummies.
Authorities responded to the residence of Candice Hickson, 43, in Milan, Tennessee, 100 miles northeast of Memphis, on Nov. 28 from reports of a possible overdose, according to WMC-TV. Police found the two kids unresponsive.
Ms. Hickson said they ate THCA gummies, legal for her to purchase and own but illegal for kids to consume, that she stored in her bathroom, according to WBBJ-TV, another Tennessee station. Ms. Hickson told officers she didn’t know how many gummies either child consumed.
The two little ones were taken to a Memphis hospital and released within 48 hours.
Meanwhile, Ms. Hickson tested positive for methamphetamine, and as such, the Tennessee Department of Children’s Services took custody of her kids, according to a press release from prosecutors cited by WBBJ-TV.
As opposed to gummies containing the psychoactive chemical in marijuana THC, which are illegal in Tennessee, the THCA gummies in this case are a nonmarijuana hemp product that, under Tennessee law, are legal to purchase for people 21 and up.
The gummies contained the nonpsychoactive precursor to THC, THCA, and minute legal amounts of other cannabinoid chemicals, according to WBBJ-TV.
Besides child endangerment, Ms. Hickson was charged with neglect, with bail set at $25,000, according to an arrest warrant cited by ABC News, and is due back in court on Dec. 16.
